Due to the flood of public comments, the State Water Resources Control Board is currently revising the proposed regulations. We anticipate substantial changes to the proposal. SWRCB staff expects to have the revised proposal completed and released for another public comment period in the next 12 months. Assembly Bill 885 required the State Water Resources Control Board to adopt regulations or standards for permitting and operating septic systems. The draft regulations, as currently proposed, would be burdensome and costly to homeowners. They would:

Require periodic testing of septic systems and domestic wells at a cost to the homeowner

Potentially limit property development

Mandate “one-size-fits-all” regulations that discount the diverse geographical, hydrogeological, and demographic characteristics that exist in California

Update! Madera County unanimously approved a resolution on February 3rd opposing the regulations unless significantly amended. The resolution is available here.
